Brief info

With the amendment in 2006 of the Ordinance on Waste Recovery and Disposal Records NachwV (see the Federal Ministry for the Environment, Nature Conservation, and Nuclear Safety), the rules have changed for everybody involved in waste disposal. The previous record procedure based on paper forms will now only be permitted in exceptional cases and in a transitional period until 2010. Instead, it will become a requirement to transmit records of proper waste management, consignment notes (Begleitscheine), handover certificates (Übernahmescheine) and registers – the successors of the record books (Nachweisbücher) – electronically.

Future process for the electronic record procedure

In order to ensure the legal equivalence of the electronic documents to the paper forms, the electronic documents must be signed with qualified electronic signatures. This results in new requirements for waste disposal organization for producers, transporters and disposal companies:

Consignment note procedure:

Consignment notes must be electronic from April 2010 on, according to the Ordinance on Waste Recovery and Disposal Records, and must be signed with a qualified electronic signature. In the transitional period until the end of 2010, producers and transporters will still be permitted to sign a receipt slip by hand. The disposal company then signs the data for officials.

The producer must sign no later than the transfer, and the transporter no later than upon acceptance. Signing is not restricted to the transfer/acceptance and does not need not be performed by the driver, but rather can – with the approval of the producer – also be done in the offices of the transporter. Handover certificates need not be electronically kept and signed.

Individual and collective records of proper waste management:

Individual and collective records of proper waste management must also be kept electronically (the same transfer guidelines apply for the producer and transporter as for the consignment note) and signed just as for consignment notes. Receipt confirmation and/or acknowledgements are electronically signed and sent by the competent authorities.

Our solution Modawi offers appropriate functionality for the eANV process, for receiving, transmittal, signing, signature verification, and archival.

Registration requirements

All documentation kept electronically must be listed in an electronic register (plus handover certificates for collectors). Upon (electronic) request from monitoring authorities, a register listing must be prepared and electronically sent to the authority.

Modawi provides a register for this purpose in which all documents for the processes are electronically archived, along with their electronic signatures.
